Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Private I iOS application ("App") or any associated services, you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Material changes will be notified via in-app notice. Continued use of the App after changes constitutes acceptance of the revised Terms.

2. Description of Service

Private I is an iOS application that uses facial recognition technology and iOS Shortcuts automation to protect designated apps on your device. When a protected app is opened, the App intercepts the launch and displays a configurable decoy screen. Access to the protected app is granted only upon successful face verification by the enrolled owner.

The App requires:

• An iPhone or iPad running iOS 16 or later
• A front-facing camera capable of face capture
• An Apple ID for App Store download and in-app purchases
• The iOS Shortcuts app for automation setup

Certain features (additional decoy styles, intruder photography, unlock history, stealth app icons) require an active Private I Pro subscription.

3. Eligibility

You must be at least 13 years of age to use Private I. By using the App, you represent and warrant that you meet this age requirement and, if you are between 13 and 18, that you have your parent or legal guardian's permission to use the App and accept these Terms.

An Apple ID is required for App Store download and in-app purchases. Apple's own age requirements for Apple IDs apply independently.

4. Acceptable Use

Private I is designed to protect your own apps on your own device. You agree to use the App only for lawful purposes and in accordance with these Terms. Specifically, you agree not to use the App:

• To surveil others without consent. You must not install or configure Private I on a device that belongs to or is regularly used by another person without their full, informed, and freely given consent.
• To facilitate abuse, coercive control, or domestic harm. Any use of the App's features to monitor, track, control, or deceive another person in an abusive or coercive manner is strictly prohibited.
• For any illegal purpose. You must not use the App to hide evidence of criminal activity, facilitate fraud, or engage in any activity that violates applicable law.
• To reverse-engineer, decompile, or tamper with the App. You must not attempt to extract source code, modify the App's behavior, or circumvent technical protection measures.
• On devices you do not own or control. The App must only be configured on devices for which you are the primary authorised user.

Violation of these provisions may result in termination of your access to the App and may expose you to civil or criminal liability.

5. No Guarantee of Protection

Face recognition accuracy may be affected by lighting conditions, device angle, physical changes to your appearance, glasses, hats, or masks. The App includes a PIN backup escape hatch for situations where face recognition cannot run.

You are solely responsible for maintaining the overall security of your device, including using a strong device passcode, keeping iOS updated, and exercising appropriate physical control of your device. We are not liable for any unauthorized access that occurs despite your use of Private I.

6. Intellectual Property

The App, including all software, design, trademarks, text, graphics, and other content, is owned by us and protected by applicable copyright, trademark, and other intellectual property laws. Your use of the App does not grant you ownership of any intellectual property rights in the App or its content.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, solely for your personal, non-commercial use, subject to these Terms and the Apple App Store Terms of Service.

7. Subscriptions and Payments

Private I offers an optional Pro subscription, available as a monthly or annual plan, processed entirely through Apple's In-App Purchase system. By subscribing, you agree to the applicable pricing displayed at the time of purchase.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Renewal charges are applied within 24 hours before the end of the current period
• Subscriptions can be managed and cancelled in your Apple ID account settings
• No refunds are provided for partially used subscription periods, except as required by applicable law or Apple's refund policy
• Free trial periods, where offered, begin immediately upon confirmation and convert to a paid subscription unless cancelled before the trial ends

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, THAT RESULTS OBTAINED FROM USE OF THE APP WILL BE ACCURATE OR RELIABLE, OR THAT DEFECTS IN THE APP WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR ITS SUBSCRIPTION IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

10. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we reasonably believe you have violated these Terms. Upon termination, your licence to use the App ceases immediately.

You may terminate your use of the App at any time by deleting it from your device. Sections of these Terms that by their nature should survive termination will do so, including but not limited to Sections 7, 8, 9, and 11.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which we are registered, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of that jurisdiction, to the extent permitted by law.

Nothing in these Terms limits your rights under any mandatory consumer protection laws that apply in your place of residence.

12. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede any prior agreements.

Severability: If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.

No Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce it in the future.

Apple: These Terms are between you and us, not Apple. Apple is not responsible for the App or its content. Apple has no obligation to furnish any maintenance or support services with respect to the App.
